Terms and Conditions of Sale
Please read the following carefully before you complete your transaction with Ardbeg.
Last updated: 5 September 2012
We apologise for the rather formal wording but as you know, sometimes even Ardbeg has to follow convention! Please read these product terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Ardbeg makes the products available to you ("Product Terms").
Please note that we can only deliver whisky to addresses in the UK. Delivery is by post or courier.
We will deliver to the address as you have entered it on the order. We cannot accept any liability for late or failed delivery if the quoted address is incorrect or incomplete. Please check the delivery address if you are uncertain. If you request a delivery to a business, we shall consider the delivery to be successful, if it is delivered to a reception area and signed for by a representative at that address. Orders will normally be delivered within 28 days of receipt. If goods fail to arrive after 28 days from date of order, please notify us on: firstname.lastname@example.org . We do our best to secure delivery within 28 days of the date of your order, but shall not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control. In the event that the order is returned to us by the courier or otherwise due to non-delivery Ardbeg gives the purchaser the option of resending the purchase at the purchaser’s expense or refunding the purchase less the cost of postage and packing. We cannot deliver to PO boxes.
The prices payable for the products that you order are clearly set out in the website. If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we despatch the item concerned. All prices are expressed inclusive of any VAT payable unless otherwise stated. The price of the items excludes the delivery charge which is calculated separately depending on destination and type of despatch service used. You will be advised of the cost of delivery on the website at the time your order is accepted. Ardbeg reserves the right to alter the prices of the goods on offer online at any time without prior notice.
Taxes and Duties
The total price we charge you for the Goods in your order includes all applicable taxes payable in the UK. If you are situated outside the United Kingdom, there may be an obligation to pay local taxes, duties, value added tax, charges or other levies imposed by your country. We will not be responsible for paying any such taxes, duties, value added tax, charges or other levies imposed by your country. On occasion, the courier or postal service may pay these charges on your behalf and you should reimburse the delivery agent accordingly. You will be responsible for payment of such sums and as purchaser you should check with your country of residence local customs office for details of such charges. We will not be responsible if your failure to pay any such sums prevents or delays us from delivering the Goods to you.
All of Ardbeg’s products and services are subject to availability, but as your website transaction is a live purchase, if you have received confirmation of order, then the goods should be available.
As all products and services are subject to availability, there will be no contract of any kind between you and us unless and until we actually process and despatch the goods to you. As stated above (under Availability) your order is an offer to buy from us. This means that nothing that we do or say amounts to any acceptance of that offer until we actually process and dispatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are processed and despatched, and not before, a contract will be made between you and us. We cannot sell alcoholic products to anyone under 18. By using this website shop, you confirm that you are at least 18 years of age and of legal drinking age in your country of residence. For this reason, we may refuse an order at our discretion and orders may not be transferred from the customer to any other person.
We hope you will be happy with your purchase. However, should you feel it necessary to return an item because it is faulty or different to those ordered, we aim to make the returns process as simple as possible. If you believe that there is a product quality issue, then please contact us on: email@example.com . We must be notified of damaged goods within 2 days of delivery. We will refund the credit/debit card used to make the purchase including postage charges incurred when we receive the items back. Purchasers may cancel the order by informing Ardbeg up to 7 days after receiving the order. Goods must be returned unopened, sealed and in original condition together with the original invoice within 7 days of the date cancelled. Ardbeg will refund the purchase within 30 days of you notifying us about the return. The cost of returning the product is the responsibility of the purchaser. Liability for loss or damage during transit is also the responsibility of the purchaser.
You can pay by any Mastercard or Visa credit card, Switch or Delta debit card. We do not currently accept Visa Electron cards. Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. You will be automatically charged for your order once your order has been acknowledged. Our liability to you in connection with any order will not exceed the total price charged for the relevant items.
